Use and Manage of Certificate

After approved by ETC, the vendor should prepare labels according to the form of Approval Label stipulated in the certificate of approval, and affix or mark the label at the appropriate position on the main body of the approved TTE prior to sale.

The exclusive right of use relating to Approval Label belongs to the one who has been granted the certificate of approval. Nevertheless, the others importing or selling TTE of the same brand name and model number, if obtaining the consent of the one who has obtained the original certificate of approval, may also use said Approval Label after submitting the certificate of consent to DGT for reference.

Once the approved TTE by ETC is modified in respect of model number, design or function, it should be re-submitted for compliance approval. Nevertheless, after modification in respect of design or function, if it remains in compliance with the relevant technical specifications, the applicant only needs to notify the ETC the part of modification for reference.

When the aforementioned TTE extends its telecommunications interfaces and does not affect the function of the approved telecommunications interfaces, it is permitted to conduct the compliance approval only upon the part of extension.

Once the relevant TTE technical specifications are amended, the approved TTE shall be re-submitted for compliance approval according to the effective date and the way of implementation as promulgated in the amended technical specifications.

Those who have lost or damaged their TTE approval certificates issued by ETC may apply for re-issue or replacement to ETC.

ETC should perform market surveillance activities on the TTE from time to time.

After granting certificate of approval for TTE, ETC may revoke or rescind the said certificate under one of the following conditions:

1. Failure to re-submit application for compliance approval when the approved TTE does not comply with the relevant technical specifications with a substantial modification in respect of model number, design and function.

2. Once the relevant technical specifications are amended, the approved equipment fails to be re-submitted for compliance approval according to the effective date and the way of implementation as promulgated in the said technical specifications

3. Data/information attached to the application package is found to be counterfeited or false.

4. After market surveillance, the TTE doesn't comply with the relevant technical specifications.

Once certificate of approval is revoked or rescinded, DGT should announce in public the original holder of the certificate of approval and the matter of revocation or rescission. The original holder shall not be permitted to re-submit an application for approval within three months, including all products the original holder holds.

According to Article 67 of Telecommunications Act, those who import or market any TTE without compliance approval should be fined NT$30,000 to NT$300,000, and their equipment should also be confiscated.

Electronics Testing Center, Taiwan is commissioned by DGT for issuing the certificate of approval, and certify equipment under the name of ETC.

According to Section 2, Article 24 of Consumer Protection Law, the mark and manual of the imported products or service should be Chinese and not fall shorter than them at original location. For protecting the right of the consumers, the applicant imported TTE should prepare the approval certificate and Chinese user manual  prior to sale.
